1. About Us
Dishpatch is a technology platform owned by Dishpatch Inc. and operated in Barbados by Dishpatch Enterprises. By accessing or using the Dishpatch application, website, or related services (collectively, the “Service”), you agree to be bound by these Terms and Conditions.
Dishpatch operates solely as an intermediary platform that facilitates connections between customers, independent merchants, and delivery partners. Dishpatch does not prepare food, manufacture products, or directly employ delivery personnel. All goods and services offered through the platform are provided by third-party merchants.
All orders placed through Dishpatch are subject to availability and confirmation. An order is considered accepted once payment has been successfully processed. Merchants are solely responsible for the preparation, quality, and accuracy of items provided. While Dishpatch may assist in resolving issues, it does not assume liability for errors made by merchants.
Orders may not be canceled once preparation has commenced. Dishpatch reserves the right to cancel any order in circumstances involving suspected fraud, technical errors, unavailability of items, or risk concerns.
Payments are processed securely through third-party payment providers. Dishpatch does not store full payment card details and is not responsible for failures or errors originating from payment processors or financial institutions.
All prices displayed on the platform may differ from in-store pricing. Delivery fees and service charges are non-refundable once the service has been completed.
Delivery times are estimates only and may vary due to factors beyond reasonable control. Customers are responsible for being available to receive deliveries.
Users agree to provide accurate information and to use the platform in good faith. Dishpatch reserves the right to suspend or terminate accounts engaged in fraud, abuse, or misuse.
2. Prohibited Use and Items
Users may not use Dishpatch to request, transport, or deliver illegal, hazardous, or restricted items. This includes but is not limited to controlled substances, weapons, stolen goods, or any items prohibited under the laws of Barbados.
Dishpatch reserves the right to refuse or cancel any order that violates these restrictions.
3. Refund, Cancellation and Chargeback Policy
Refunds may be granted where an order was not delivered, was materially incorrect, or was canceled prior to preparation. Refunds are issued at the sole discretion of Dishpatch.
Dishpatch reserves the right to deny refund requests that do not meet policy requirements, including minor issues or customer unavailability.
All chargebacks or payment disputes initiated without first contacting Dishpatch may be contested. Users engaging in fraudulent chargebacks may have their accounts permanently suspended and may be subject to legal action.
4. Limitation of Liability
To the fullest extent permitted by law, Dishpatch shall not be liable for indirect, incidental, or consequential damages. This includes but is not limited to loss of profits, delays, service interruptions, or issues arising from merchants or delivery partners.
Dishpatch’s total liability, where applicable, shall not exceed the value of the transaction in question.
5. Indemnification
Users agree to indemnify and hold harmless Dishpatch, its directors, affiliates, and partners from any claims, damages, liabilities, or expenses arising from misuse of the platform, violation of these Terms, or infringement of any rights.
6. Merchant Terms
Merchants are responsible for the accuracy, quality, and safety of all products offered. They must comply with all applicable health, safety, and business regulations.
Dishpatch reserves the right to suspend or remove merchants that fail to meet standards or violate policies.
7. Delivery Partner Terms
Delivery partners operate as independent contractors and are solely responsible for their conduct. They must comply with all applicable laws, maintain valid documentation, and operate safely.
Dishpatch shall not be held liable for the negligence, misconduct, or actions of delivery partners.
8. Privacy Policy
Dishpatch collects and processes personal data necessary to provide its services, including contact details, delivery information, and transaction records.
Data is used to facilitate orders, improve services, communicate with users, and prevent fraud. Information may be shared with merchants, delivery partners, and payment processors strictly for operational purposes.
Dishpatch does not sell personal data and applies reasonable security measures to protect user information.
9. Intellectual Property
All intellectual property associated with Dishpatch is owned by Dishpatch Inc. Unauthorized use is strictly prohibited.
10. Force Majeure
Dishpatch shall not be held liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, weather conditions, strikes, technical failures, or governmental actions.
11. Dispute Resolution
Any disputes arising from the use of Dishpatch shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the jurisdiction of the courts of Barbados.
12. Governing Law
These Terms are governed by the laws of Barbados.
